This Privacy Policy (“Policy”) explains how Be Resilient, LLC and its affiliates (“Be Resilient”, “we”, “our”) collect information from or about you (“you” or “your”) when you visit the websites, portal, or any applications, social media networks, or interactive features, and use our services (the “Services”) or otherwise communicate with us, and how we use, maintain, protect, and disclose that data.

This Policy is incorporated into the Terms and Conditions of Use and is supplemented by our Consumer Health Data Privacy Policy, which describes our collection, use, and sharing of consumer health data.

Information We Collect

We may collect information about you including non-personally identifiable information and/or “Personal Information,” which is information that is linked to, relates to, describes, or is capable of being associated with or reasonably linkable to an identified or identifiable person     .

Personal Information we might collect includes data such as the following:

  • Identifiers and demographic information, such as your name, address, phone number, email address, date of birth, age, gender, race/ethnicity, and faith/spirituality.

  • Family, social, and relationship information, such as your occupation and relationship and family status.

  • Health information, such as health conditions, diagnoses and medical history, medication information, medical treatment and therapies information, and physical, mental, and emotional symptoms.

  • Financial information, such as credit card number or debit card number and address or other information related to a billing or payment transaction.

  • Commercial information, such as the products or services you purchase from us.

  • Device and usage information, such as about your device and how you interact with our website, including your Internet Protocol address, browser type, operating system, unique device identifiers, device attributes, network connection type, browsing history, search history, pages visited, clickstream data, and information about your interaction with the website or our emails.

  • Geolocation data, such as information about your device’s location, which may be inferred from your IP address.

We do not consider Personal Information to include information that can no longer be used to identify a specific natural person, whether in combination with other information or otherwise. For example, de-identified consumer information.

Personal Information does not include publicly available information from government records.

If we combine non-personally identifiable information with Personal Information, we will treat such information appropriately, but not all rights may apply to the non-personally identifiable information portion. We may disclose information that is not Personal Information to third parties at our discretion.

Collection Methods

Most of the Personal Information we receive relates to your use of and participation in our Services, and you generally control the amount and type of information you voluntarily provide to us when using the Services. We may offer you choices when we ask for Personal Information if reasonably possible. In some instances, we automatically collect certain types of information when you use our Services or correspond with us.

For example, we may collect information through the following methods:

  • Direct contact with Be Resilient employees. This includes records and copies of your correspondence (including email addresses and phone numbers), if you contact us.

  • Third parties such as software and service providers, such as hosting providers, data analytics providers, email or communications providers, or advertising providers.

  • Automatically, when you interact with the Services. This may include information about your interactions with the Services, such as the date and time of any visit or information you enter into the Services, and your interactions with content or features that you access. It may also include technical data such as URL information and your IP address, the types of devices you are using to access or connect to the Services, unique device identifiers, device attributes, network connection type, and other device and network information. We may collect this information ourselves or through third parties, such as service providers (including hosting providers), data analytics service providers, or advertising service providers, including social media platforms.

How We Use Personal Information That We Collect for Business or Commercial Purposes

We may use your Personal Information to:

  • provide you with our Services;

How Long We Retain Your Personal Information

Be Resilient retains your Personal Information only for as long as is necessary for our legitimate business purposes. We will retain and use your Personal Information to the extent necessary to comply with our legal, accounting, or reporting obligations (for example, if we are required to retain your data to comply with applicable laws), resolve disputes, and enforce our legal agreements and policies. Additionally, we may continue to store your Personal Information contained in our standard back-ups. This applies to all categories of Personal Information in use by us.

Tracking Technologies; Third-Party Advertisements

Cookies

Cookies are small data files that are downloaded onto your computer or mobile device when you use our Services, which are unique to your device or account. Cookies make it easier for you to use our Services by saving your preferences so that we can use these to improve your next and subsequent visits to our Services. Cookies help us learn which areas of our Services are useful and which areas need improvement.

  • Service providers who assist us in operating our website, providing our Services, conducting our business, or servicing you (for example, we use Shopify to host our website).

  • Analytics providers to gather information about how you and other users engage with our website. For example, we use Shopify for this purpose, and Shopify may also gather Personal Information collected about your interactions with our store, along with other merchants, and with Shopify. In these circumstances, Shopify is responsible for the processing of your personal information, including for responding to your requests to exercise your rights over use of your personal information for these purposes.   • Advertising providers, including social media partners, that we use to communicate with you or to support the promotion and advertising of the Services, including targeted ads on third-party sites.

  • A successor or other entity in the event of a merger, acquisition, sale of assets, joint venture, assignment, transfer, or other disposition of all or any portion of our business, assets, or stock (including in connection with any bankruptcy or similar proceedings).

Additionally, we may also disclose your Personal Information:

  • To comply with any court order, law, or legal process, including to respond to any government or regulatory request.

  • To enforce our rights arising from any contracts entered into between you and us, including the Terms and Conditions of Use.

Marketing Communications

Be Resilient will communicate with you by text message in accordance with our Mobile Text Program Terms, which govern our mobile text messaging practices. If you have supplied your email address, you agree that we may send you emails to provide you with information, to inform you of new products, to solicit your feedback, or to keep you up to date about Be Resilient and our products and services. To unsubscribe from marketing emails, please follow the instructions included in our marketing emails. Please note that even if you choose not to receive marketing communications from us, you still may receive communications regarding your account and any other service-related issues and updates that will allow us to provide you with the optimal user experience and other matters that are not marketing.

Keeping Your Information Secure

Be Resilient has adopted physical, technical, and administrative measures that are designed to prevent unauthorized access or disclosure, maintain data accuracy, and ensure appropriate use of Personal Information. We cannot, however, ensure or warrant the security of information. No security measures are infallible.

Links to Other Sites

Our Services may be accessed from or contain links to other websites that we do not own or operate. If you access those links, you will leave our Services. Be Resilient does not control those third-party websites or their privacy practices, which may differ from ours. We do not endorse or make any representations about third-party sites, including about the content or security of those sites. The information you choose to provide to or that is collected by these third parties is not covered by this Policy.

Children's Privacy

We do not knowingly collect information from individuals under the age of thirteen (13) (“children”), and we do not target our Services to children. If we learn that we have collected any information from children, we will delete it.

Your Consumer Privacy Rights

Depending on where you live, you may have certain rights with respect to Personal Information that we have collected and used under certain circumstances. Not all rights are available in all states. Subject to applicable law, you may have the following rights:

  • The right to confirm whether we are processing your Personal Information and access to your Personal Information.

  • The right to receive a portable copy of your Personal Information.

  • The right to correct inaccurate Personal Information.

  • The right to request deletion of your Personal Information.

  • The right to request a list of the specific third parties to whom we have sold Personal Information (if any).

  • The right to opt out of certain uses and disclosures of your Personal Information, including from:

    • the sale of your Personal Information, 

    • the use of your Personal Information for targeted advertising, and 

    • the use of your Personal Information for profiling in furtherance of decisions that produce legal or similarly significant effects concerning you.

  •      The right to appeal a denial of your privacy rights requests.

These rights will not apply, however, if Be Resilient does not collect any Personal Information about you or if all of the information we collect is exempt (for example, information that is already publicly available).

Be Resilient will not discriminate against any consumer because such person exercised any of the consumer’s rights under these privacy laws. Be Resilient may, however, charge a different price or rate, or provide a different level or quality of goods or services, if that difference is related to the value provided to you by your data.

To the extent our use of cookies or other tracking technologies is considered a “sale” of Personal Information or involves targeted advertising, you can exercise your opt out rights by adjusting your cookie preferences on our website.   

For certain types of requests, we may need to verify your identity. In those cases, you will need to provide us with certain information such as your name, email address, physical address, or other information, as relevant, so that we can verify that you are who you say you are. Which information may depend on the type and sensitivity of information requested.

How to Appeal


If we decline to take action on your request, you may appeal our decision by replying to our response or by contacting us as described above and stating that you are appealing a privacy request decision.

Notice to Visitors Outside of the United States

If you are located outside of the United States and choose to provide information to us, please note that we are a U.S. company, that the Services are intended solely for residents of the United States, and we transfer information to the United States for processing, where the data protection laws may differ from those of your jurisdiction. Your submission of such Personal Information will be considered agreement to that transfer.

From time to time, we may change this Privacy Policy. If we make changes, we will revise the “Last Updated” date at the top of this Notice. We encourage you to review this Notice periodically to be sure you are aware of those changes. Changes will become effective as of the “Last Updated” date.
