At Be Resilient, we know that privacy is important to you. Your privacy is important to us too. This Consumer Health Data Privacy Policy (“Policy”) explains how Be Resilient, LLC and its affiliates (“Be Resilient”, “we”, “our”) collect consumer health data from or about you (“you” or “your”) when you visit our websites, portal, applications, social media networks, interactive features, and in connection with our products and services (the “Services”) or otherwise communicate with us, and how we use, maintain, protect and disclose that data.

Please note that Be Resilient is not a covered entity, such as a health plan or health care provider, under the Health Insurance Portability and Accountability Act of 1996 (commonly known as “HIPAA”). As a result, we are not subject to the requirements of HIPAA that apply to such entities.

Consumer Health Data We Collect

We may collect information about you including “Consumer Health Data,” which is personally identifiable data that is linked or reasonably linkable to a consumer and that identifies the consumer’s past, present or future physical or mental health status. 

Consumer Health Data we may collect includes data such as the following:

  • Individual health conditions or status, treatment, diseases, or diagnosis. 

  • Social, psychological, behavioral, or medical interventions.

  • Health-related surgeries or procedures. 

  • Use or purchase of prescribed medication. 

  • Bodily functions, vital signs, symptoms, or measurements of the information described herein.

  • Diagnoses or diagnostic testing, treatment, or medication.

  • Genetic data. 

Consumer Health Data does not include information that can no longer be used to identify you, whether in combination with other information or otherwise, including, for example, de-identified or aggregated consumer information. Consumer Health Data also does not include publicly available information from government records. If we combine non-personally identifiable information with Consumer Health Data, we will treat that information as Consumer Health Data.

How We Use Consumer Health Data

We may use your Consumer Health Data to:

  • provide you with our Services; 

  • identify you in order to respond to requests, personalize information we provide to you, or otherwise as described below;

  • design, improve, and administer our Services;

  • improve our Services;

  • protect our rights and protect your safety or the safety of others;

  • investigate fraud or respond to government inquiries;

  • complete corporate transactions (from time to time, we may sell, buy, merge or otherwise reorganize our businesses, and these corporate restructurings may involve disclosure of Consumer Health Data to prospective or actual purchasers, or the receipt of it from sellers);

  • comply with laws, regulations or other legal process; or

  • otherwise use your Consumer Health Data with your consent.

Sharing of Consumer Health Data 

We do not sell Consumer Health Data. We may share Consumer Health Data with the following categories of third parties below:

  • Labs who provide testing services to us and you.

  • Supplement manufacturers for personalization of supplement formulas.

  • Wellness and nutrition specialists with whom we engage to provide you our Services.

  • Service providers who assist us in providing our Services, conducting our business, or servicing you, such as software providers and platforms used to assist in building nutritional meal plan guides.

Rights of Individuals in Washington and Nevada

If you live or receive services in Washington or Nevada, you have certain rights with respect to Consumer Health Data that we have collected and used under certain circumstances, which may include the following:

  • Right to Access. You have the right to confirm whether we are collecting, sharing, or selling your Consumer Health Data and to access such data, including a list of all third parties and affiliates with whom we have shared or sold your Consumer Health Data and, in some cases, an active email address or other online mechanism that you may use to contact those third parties.

  • Right to Withdraw Consent. Where we collect and share your Consumer Health Data based on your consent, you have the right to withdraw your consent from that collection and sharing. 

  • Right to Delete. You have the right to request that we delete your Consumer Health Data. 

  • Right to Appeal. If we decline to take action on your request, you have the right to appeal our decision as described below.

 How to Make Requests

To make a request to exercise one of the rights above, please submit a request to hello@redeemfm.com

For certain types of requests, we may need to verify your identity. In those cases, you will need to provide us with certain information such as your name, email address, physical address, or other information, as relevant, so that we can verify that you are who you say you are. Which information may depend on the type and sensitivity of information requested.

How to Appeal

If we decline to take action on your request, you may appeal our decision by emailing us as described above and stating that you are appealing a privacy request decision.

We will respond to your appeal within the timeframe required by your state’s law with a written explanation of our decision.

Updates to This Privacy Policy

From time to time, we may change this Policy. If we make changes, we will revise the “Last Updated” date at the top of this Policy. We encourage you to review this Policy periodically to be sure you are aware of those changes. Changes will become effective as of the “Last Updated” date.
